  1. These Terms & Conditions apply to all guests, registered users or others who access or use the Website and shall govern the use of the Website. All users are required to read these Terms & Conditions carefully before using the website. By accessing and/or using the website the user agrees to bound by these terms & Conditions. In case user does not agree with these terms & Conditions, user should immediately cease using the website.
  2. The user is granted a non-transferable and revocable license to use the website under these terms & Conditions, for the sole purpose of purchasing any item that are posted for sale on the website.
  3. The website is operated by MC Home Depot, Inc. a corporation duly organized and existing by and under the laws of the Philippines, with head office address at 168 Ortigas Avenue cor. Meralco Avenue, Ortigas Center, Pasig City.
  4. MC Home Depot reserves the right to change, alter, modify or remove the terms & Conditions at any time without prior notice to the user.
  5. Registered users shall solely be responsible for their accounts, and they agree to, and hereby, release MC Home Depot from any liability in case of any damage that may result to the registered users for any unauthorized access to their accounts.
  6. Users shall not in any way, directly or indirectly, use the website or submit to MC Home Depot or to the website anything which in any respect is: 
    1. in breach of any law, statute or regulation;
    2. deceptive, false, fraudulent, misleading or unlawful; or
    3. obscene, indecent, pornographic, profane, vulgar, racist, sexist, discriminatory, offensive, derogatory, harmful, harassing, threatening, embarrassing, malicious or in any way abusive.
  7. Users agree to comply at all times with any instructions for the use of the website which MC Home Depot may implement from time to time.
  8. Users shall render MC Home Depot free and harmless from any liability or responsibility in relation to user’s inability to use or delay in use of the website or any material in it.
  9. MC Home Depot and MC Home Depot’s suppliers and distributors will not be responsible for lost profits, revenues or data, financial loses or exemplary or punitive damages. To the extent permitted by law, the total liability of MC Home Depot and its suppliers and distributors for any claim under these Terms & Conditions, including any implied warranties, is limited to the amount the registered user has paid to purchase the item for sale in the website. In all cases, MC Home Depot and its suppliers and distributors will not be liable for any loss or damage sustained by users, whether as guests or registered users, that are not foreseeable, caused by force majeure, or in general, beyond their control.

MC Home Depot’s logos and any other MC Home Depot and its suppliers’ and distributors’ product or service name or slogan (collectively, “Marks”) are trademarks of MC Home Depot and its suppliers’ and distributors’, and may not be copied, imitated or used, in whole or in part, without the prior written permission of MC Home Depot or the applicable trademark holder. All other trademarks, registered trademarks, product names, company names, and logos mentioned in the Marks and/or website (“Third-Party Trademarks”) are the property of their respective owners, and any use of Third-Party Trademarks will inure to the benefit of the applicable trademark owner.
  11. Except as otherwise indicated, all content on the website, including text, graphics, logos, button icons, photos, images, and forms, are the property of MC Home Depot or its licensors. The compilation of all content on the website is the exclusive property of MC Home Depot or its licensors. Users will not use the website except in its intended manner in accordance these Term & Conditions. MC Home Depot reserves all rights not expressly granted in these Term & Conditions, and no licenses or rights are granted by MC Home Depot to users under these Term & Conditions, whether by implication, estoppel or otherwise.
  12. Users, whether guests or registered users, expressly understand and agree that users’ use of the website is at its sole risk. The website and items for sale on the website are provided on an “as is” and “as available” basis. MC Home Depot and its sister companies, officers, employees, agents, partners, and licensors expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
  13. MC Home Depot and its licensors make no warranty that the item description or quality of the item will meet Users’ requirements.
  14. The customer service department of MC Home Depot is open and available to address all concerns of the users. The said department may be reached via email at info@mchomedepot.com or via phone call at (+632) 636-6944 from Mondays through Saturdays, 8am-6:00pm.
  15. Any claim, dispute, legal action or proceeding arising out of or connected with the use of the website and online sale transaction shall be brought in the proper courts of Pasig City only to the exclusion of all other venues.
  16. The Terms and Conditions and all transactions in the website shall be governed by the laws of the Republic of the Philippines.
  17. In the event that any of the terms herein or policies should be declared contrary to law or public policy, or is otherwise declared invalid or unenforceable, such term or policy shall not affect the validity of the remaining terms or policies which shall remain in full force and effect and continue to be binding and enforceable.

MC Home Depot may suspend or terminate Users’ rights to access the Website for any reason, without notice, and at MC Home Depot’s sole discretion and without having to give a reason and without liability for such suspension and/or termination. Suspension or termination may include restricting access to and use of the wbsite. These Terms & Conditions are effective until terminated by MC Home Depot. Users’ rights under these Terms & Conditions will terminate automatically without notice from MC Home Depot if users fail to comply with any of these Terms & Conditions.
